How Notice Periods Work in Germany

German contracts — gym memberships, phone plans, insurance policies, subscriptions — typically renew automatically unless you cancel in time. The cancellation notice is called a Kündigung, and the notice period is the Kündigungsfrist. The rule that surprises most newcomers: the deadline refers to the day your letter arrives at the provider (Zugang), not the day you send it. A three-month notice period on a contract ending 31 December means your Kündigung must be in the provider's hands by 30 September. To work out your own deadline, you need three details from the contract: the start date, the term length, and the notice period — then count backwards from the end of the term and allow generously for postal delivery. Miss the cut-off, and a renewal clause can extend the contract by months or another full year. For many newer consumer contracts, monthly cancellation is possible after the initial term, but whether that applies to yours depends on the contract type and signing date — the fine print decides.

Schriftform, Textform, and Registered Mail

Many consumer contracts can now be cancelled in Textform — text form, such as e-mail, without a handwritten signature. Employment contracts and residential leases, however, still require Schriftform: a paper letter with your handwritten signature. Your contract's cancellation clause states which form applies; when unsure, send a signed letter, which satisfies both standards. Since you may later need to prove your notice arrived on time, the usual German practice is registered mail, an Einschreiben. The Einwurf-Einschreiben — where the carrier documents dropping the letter into the mailbox — is generally the practical choice. The hand-over variant (Übergabe-Einschreiben) can backfire: if nobody is home and the letter is never collected, delivery may not count. Keep the posting receipt and ask the provider for written confirmation of the cancellation.

Sonderkündigungsrecht: Cancelling Outside the Normal Deadline

In certain situations you may terminate a contract extraordinarily, without waiting for the regular notice period. Typical triggers are price increases on energy or telecom contracts, a move to a place where the provider cannot deliver the service, or premium increases on insurance policies. The conditions differ by contract type, and the window to act is usually short. If you have such a reason, act quickly, label the letter explicitly as a Sonderkündigung, and state the reason — otherwise it may simply be treated as a regular cancellation at the next possible date.
